HAN YOUNG STRIKE REACTIVATED

Tijuana B C a 12 junio de 2000

Workers from the maquiladora Han Young in Tijuana, Mexico (now known as "TRAHO Servicios de Tijuana"; TRA for transportation and HO for Ho Young Lee, Han Young's owner) that produces chassis for Hyundai tracter trailers reactivated their strike Monday June 12 after winning two appeals in Mexican Federal courts last week. One appeal (Second Associated Federal Court, 15th Circuit, Appeal #894/99 in relation to judgement 609/99) overturned a lower court's decision that authorized the forcible eviction of strikers from outside the plant and declared the strike invalid last year. The other federal determination found in favor of the indepedent October 6 Union's right to represent Han Young workers in contract negotiations with the company (First Associated Federal Court, 15th Circuit, Appeal #735/99 in relation to judgement 435/99).

 

These decisions of the 15th Circuit Federal Court in Mexicali (that now must once again protect the strikers and their union) cited flagrant violations of the law by the local Labor Board representatives who permited non-employees and administrative personnel of the plant to vote in the union election. In similar demonstration of fraud and bad faith, local Labor board officials conducted new hearings at the company's former address in order to declare the strike "non-existent on the supposed basis that no machinery nor strikers of Han Young could be found at the location. The Federal Court found that it was precisely this evidence that should have been sufficient to verify the workers' arguments and reasons for establishing the strike at the company's new location in Frac. El Lago, Tijuana; that it was obvious that strikers were dealing with the same employer at the new location. Thus, the decision found, it was only for purposes of forcibly removing the strike that the Labor Board went to the old address and not to determine whether the strike existed as they had claimed.

 

Upon receiving these new resolutions in favor of the strike and the right to represent Han Young workers in contract negotiations, we re-initiated the strike at 6AM Monday. The company kept strikebreaking thugs on guard who had been hired by the CROC (the government-affiliated union that has signed "protection contracts" with the vast majority of Baja California's maquiladoras). They were visibly drugged and armed with pipes to agitate the new workers to confront us and protect the company from a reactivation of the strike. Nevertheless, after October 6 Union members arrived at 8AM to install the strike flags and formally begin the work suspension, these company-paid thugs initiated physical and verbal confrontations that continued throughout the day. Thus, realizing at the end of the day that the company planned to bring in more thugs to break the strike and almost certain that we would regret the possible results, we weighed the risk involved and decided to establish a unilateral truce at 5:30pm with the company in order to look for avenues for negotiation with the company and the state government that has protected it.

 

It was only Monday that the company realized that a public seminar on freedom of association to organize was being put together by the trinational coordination of the National Administative Office (the office that regulates labor rights violations under the North American Free Trade Agreement) and would be held in Tijuana in the near future. We gained the committment to a private hearing prior to the public forum to seek a definitive resolution to the damage that had been caused to the Han Young workers. If there is no solution from these talks, we'll have to continue the strike during those dates.

Este lunes 12 de junio los trabajadores de la Maquiladora Han Young de Mexico (ahora Traho servicios de Tijuana)(TRAHO significa transportaciones HO nombre del coreano HO YOUNG LEE dueño de Han Young) instalaron de nueva cuenta las banderas de huelga, al haber ganado el fin de semana pasado dos resoluciones una respecto a la existencia legal de la huelga (amparo en revision toca numero 894/99 relativo al juicio 609/99) (SEGUNDO TRIBUNAL COLEGIADO) y otra con respecto a el derecho de titularidad del contrato colectivo de trabajo por el Sindicato "6 de Octubre" (amparo en revision laboral toca numero 735/99 relativo al juicio de amparo ---------laboral numero 435/99 )(PRIMER TRIBUNAL COLEGIADO). El Tribunal XV circuito colegiado de Mexicali que ampara y protege de nueva cuenta a los trabajadores y su sindicato 6 de octubre, establece violaciones flagrantes de parte de la Junta de Conciliacion y arbitraje que permitio que votaran en los recuentos personas que no trabajaban para la Empresa asi como los empleados de confianza, asi mismo evidencia el dolo y mala fe de la autoridad laboral de efectuar nuevas deligencias de parte de la Junta en el anterior domicilio de la Empresa, para declarar inexistente la huelga al no haber supuestamente maquinaria ni trabajador alguno que permitiera identificar a la Empresa Han Young, esto mismo señala hoy el Tribunal federal debio bastar a la autoridad laboral para dar por ciertos los argumentos y razones de los trabajadores para que instalaran la huega en el nuevo domicilio ubicado en el Frac El Lago, por ser
obvio que se trataba de la misma fuente de trabajo y no que como se hizo de que para fines de desalojo la junta de Conciliacion si ubico el nuevo domicilio y no asi para determinar la existencia de huelga.


Al tener esta nueva resolucion de existencia de huelga y de derecho a la titularidad del contrato colectivo de trabajo, este lunes en punto de las 6 de la mañana iniciamos de nueva cuenta la huelga, la empresa mantenia en guardia esquiroles de la CROC contratados visiblemente drogados y armados con tubos quienes agitaban a los trabajadores nuevos de la Empresa para confrontarnos y proteger a la Empresa de la continuacion de la huelga, sin embargo luego de la llegada de afiliados del sindicato 6 de octubre logramos a las 8 de la mañana instalar las banderas de huelga y una suspencion total de labores, teniendo a lo largo del dia enfrentamientos fisicos y verbales con los golpeadores contratados por la Empresa. Sin embargo midiendo el riezgo latente al terminar el dia por la actitud de la empresa de traer mas golpeadores para romper la huelga y la casi segura posibilidad de que ocurrieran hechos que lamentar, decidimos establecer una tregua unilateral a las 17:30 hrs para buscar vias de negociacion con la Empresa y el Gobierno de Estado quienes les dan proteccion, hasta el dia en que habra de realizarse el seminario publico sobre la libre asociacion sindical que se celebrara en la Ciudad de Tijuana, por el organismo TRINACIONAL de la NAO (OAN) (oficina nacional administrativa) que regula los derechos laborales en el marco del tratado de libre comercio(TLC), estamos a la espera del compromiso de una audiencia privada previa a la publica para buscar resolver en definitivo el
daño ocasionado a los trabajadores, de no haber solucion habremos de continuar la huelga por esas mismas fechas
